Terms and Conditions of the Service

  • EnCAD is a company that operates in the field of customization of the Cube.
  • that EnCAD has gradually assumed a leading position in this sector;
  • the adoption and development of specific marketing policies and the systematic enhancement of the product contributed positively to this statement;

 

ALL OF THE PREVIOUSLY, THE FOLLOWING IS AGREED

  • the premises are confirmed point by point by the parties as additions to this contract;
  • the relationship between EnCAD and the user is governed exclusively by the following agreement, excluding any other agreement, unless agreed in writing form.
 

1. SERVICE

The Service provided by EnCAD is defined as a distance selling model. In particular, the service consists in the supply by EnCAD to the customer, of all the products contained in the e-commerce website www.iltuocubo.com. and in the logistic management of the order on behalf of the Customer, including the preparation of the package, packaging and shipping to the address of the final customer.

The simulated graphics on the website are indicative and not exactly identical to the position / size of the cutout of the cubes made; these depend on the type of cube and the distance between one square and another, which cannot be predicted online.

 

2. NATURE OF THE INFORMATION PROVIDED

The technical information contained in the website is obtained from the information provided to us by the manufacturers, brands, materials, dimensions of the goods included in our catalog.

 

3. OBLIGATIONS OF EnCAD

EnCAD is committed to ensuring the continuity of the service, except in cases of force majeure (such us, as an example and not exhaustive,calamities and other natural events, national strikes, etc), unforeseeable circumstances or technical failures, it being understood that in each of the aforementioned cases, EnCAD will promptly inform the Customer and endeavor to restore the interrupted service as soon as possible. EnCAD undertakes to keep the Database inserted on the website constantly updated.

 

4. OBLIGATIONS OF THE CUSTOMER

The Customer undertakes to comply with the following obligations, the violation of which this agreement will be considered resolved and the service discontinued:
a) Inform your own customers of the PROHIBITION of using the cube to children under the age of 14.
b) The Customer undertakes to use the Service according to the indications provided by EnCAD;
c) in the case of a reseller, the Customer undertakes to not reduce or discount its retail prices below the retail prices on the portal www.iltuocubo.com and / or www.personalizzami.com.

 

5. ORDERS AND PAYMENTS

Payment and invoicing of the ordered products will take place every 15 days in the case of a commercial agreement for the reseller. In the case of private customers, payment must be made before the product is manufactured. The preparation of the order and its shipment are immediate upon receipt of the order. Payments can be made exclusively by bank transfer, post pay, PayPal or cash on delivery (in this case the price will be increased by € 7.00 on the total order for cash on delivery costs), no further forms of payment will be accepted unless expressly requested in writing.

 

6. SHIPPING, DELIVERY AND RELATED EXPENSES

EnCAD guarantees shipping throughout the territory with the following terms:
Each shipment travels at the risk of the End Customer. Orders sent to EnCAD by 10.00 every day, from Monday to Friday, will be immediately prepared and shipped within 5 working days. Deliveries will be made with the types listed in the price list, with delivery throughout the national territory, within the next day (express courier) or within 6 days (recommended), with the exception of islands and small urban centers that are difficult to reach which will be served within 48 hours in the case of shipments within 24 hours, and within 7 days in the case of 3-day shipments. The times are those communicated by the shipping agency and are to be considered approximate.
Each package, by law, will contain a transport document or invoice with your address inside.
In the case of resellers, the Customer will be solely responsible for sending the invoice or tax receipt relating to the sale to the Final Customer, by e-mail, fax or any other system deemed useful.
EnCAD undertakes to do its utmost to comply with the expected delivery times but will in no case be held responsible for any delays in delivery of the package or for damage caused by it to the customer. Delay in delivery can never be considered a reason for canceling an order.
EnCAD will provide the customer with the tracking number and / or the identification code of the shipment so that it can follow its progress, manage stocks and, upon request, inform the Final Customer about its status. The courier will make a maximum of three (3) attempts, after which the package will be returned. In case of return of the package, the order will be canceled and the customer cannot be refunded in any way, therefore if you do not want to give up the ordered goods you will have to request a new shipment at your expense.

 

7. COMPLAINTS

It will be the responsibility of the retailer to ensure that the End Customer checks the integrity of the package and its possible acceptance of the delivery with reserve. EnCAD will support the reseller in the relationship with the End Customer in cases concerning Complaints and Warranties, provided that the same relationship is governed by the rules contained in the D.L. n. 185 of 22/05/1999 (Right of Withdrawal) and n. 24 of 2/2/2002 (Complaints and Guarantees). Products that are considered non-compliant, non-functional or defective can only be replaced following an examination by EnCAD.Defects and non-conformities must be proven by sending photographs by e-mail to EnCAD customer service (info@iltuocubo.com). If the photographs are not sufficient, the disputed products must be returned to EnCAD at the Customer's expense to the following address:

No product can be returned without the permission of EnCAD, the products sent must be in perfect condition, carefully packed in the original packaging containing all the components and accessories.
Any product whose failures and / or defects are due to external causes or improper use will not be replaced.

 

8. EFFECTS OF TERMINATION OF THE AGREEMENT

Upon termination of this agreement, by EnCAD or the Customer, all rights of the Customer deriving from this agreement, and the provision of services by EnCAD, will cease with immediate effect. The reseller is also required to delete all data concerning EnCAD data, in any form and on any medium it has been stored, also eliminating any backup copies.

 

9. EXCLUSIONS

This agreement does not constitute any relationship of subordination, dependence or agency between EnCAD and the reseller,furthermore, it does not attribute to the Seller any power of representation of EnCAD or of the brands that EnCAD distributes.
The use of the file does not give the right to mention EnCAD or its logo as the source of information.

 

10. LIMITS OF LIABILITY

The Customer will not be able to hold EnCAD responsible for any type of loss or damage, direct or indirect, whatever the cause.

EnCAD markets the products on the site, does not produce them, purchases them and personalizes them with the particular customer requests. The indications of the materials and the composition of the fabrics are those indicated by the manufacturer. EnCAD is not responsible for any information incorrectly provided by the manufacturer and cannot be held responsible for damage caused by improper use of the items.
